Parties using this resource should ensure they are independently confirming the information contained herein before relying on the same. WHO MAY CLAIM Every person (contractor and subcontractor) who performs work or furnishes material in furtherance of improvement under a contract (express or implied) with owner, lessee, or appropriate agent. OH REVCODE § 1311.02 DEADLINE TO PERFECT Deadline to file lien depends on type of project: • Residential: 60 days from the date of last labor or work • Oil and Gas Well: 120 days from the date of last labor or work • Other (Including Commercial Project): 75 days from the date of last labor or work NOTE: Subcontracts are required to provide a Notice of Furnishing within 21 days of performing first work or furnishing first material if not in direct privity of contract with owner. OH REVCODE § 1311.04 OH REVCODE § 1311.05 OH REVCODE § 1311.06 BROKEN PRIORITY Effective date of mechanics’ lien is the earlier of (1) commencement of first visible work or (2) recordation of notice of commencement (NOC). NOTE: • Lien date for work can be split where portion pre-dates NOC and portion post-dates (attach upon commencement and attach upon NOC, respectively). • Laborer’s lien will always attach as of date of visible commencement. OH REVCODE § 1311.14 OH REVCODE § 1311.13 DURATION OF LIEN Enforcement period depends on whether public/private project: • Private: within 6 years from the filing of the lien affidavit • Public: within 6 years from the time the cause of action accrues pursuant to OHREVCODE § 2305.07 . Akron Concrete Corp. v. Medina City Sch. Dist. Bd. of Edn., 2012-Ohio-2971 (finding mechanics’ lien was enforceable 8 years after lien affidavit filed). EXCEPTIONS: Lien will terminate if not enforced within 60 days of receipt of ‘notice to lienholder to commence suit’ under OH REVCODE § 1311.11 (private) or OH REVCODE § 1311.311 (public) OH REVCODE § 1311.13 CONTENTS OF LIEN (1) Verified affidavit under oath; (2) amount due; (3) description of the property charged with lien; (4) name and address of person to/for whom labor or materials furnished; (5) name of the owner/ lessee, if known; (6) name and address of lien claimant; and (7) first and last day lien claimant’s labor or materials furnished. Strict compliance required. Sufficient so long as required information is included. Obvious or clerical errors will not invalidate unless prejudicial to third parties.
