N.D.C.C. § 35-27-02 DEADLINE TO PERFECT In order to have special priority, lien must be filed within 90 days after last date of contribution of work or materials. N.D.C.C. § 35-27-13 BROKEN PRIORITY Liens’ attachment date differs as to owners versus bona fide purchaser, mortgagee, or encumbrancer without notice: • Owner: liens attach upon first material or labor being furnished upon the premises. • BFP, mortgagee, or encumbrancers without notice: liens attach upon actual visible beginning of the improvement. The following will have priority over previously recorded mechanics’ lien: • Construction mortgage given in good faith to pay for materials or improvements • Existing but unrecorded mortgages or encumbrances which mechanics’ lien holder has actual notice of. N.D.C.C. § 35-27-03 N.D.C.C. § 35-27-04 DURATION OF LIEN Lien is not valid, effective, or enforceable, unless the lienor commences an action and records with the county recorder a lis pendens within 3 years after the date of recording of the lien. EXCEPTIONS: Lien will lapse if not enforced within 30 days of an owner recording and giving claimant a written demand to commence suit. N.D.C.C. § 35-27-25 CONTENTS OF LIEN (1) Description of the property; (2) the amount due; (3) dates of the first and last contribution; and (4) person with which the claimant contracted.
